Is Instagram's 'paid partnership...' feature enough as a label?
Instagram's built-in partnership label is a good foundation, but courts do not always see it as sufficient on its own. Problems arise especially when the notice is easy to overlook in the Instagram interface or when additional advertising in the post—like discount codes or purchase links—goes beyond the partnership label. It is therefore safer to add a further, clearly visible notice in your text such as 'Advertising' or 'Advertisement', particularly at the start of your post. For Stories and Reels, add an on-screen or spoken label so the notice does not get lost in quick scrolling.
